What is title insurance?

A policy of title insurance insures the holder against loss or damage caused by a defect in the insured property.

How is the title report prepared?

A 40-year search of the “chain” of title to the subject property is completed by a professional searcher and passed on to an examiner, who examines all documentation filed recorded that affect that property. A report is prepared, outlining the details concerning any liens, encumbrances, covenants and restrictions (issues that could affect ownership). Attorneys for both buyer and seller work with your title professional to resolve any issues and get you to the closing table.

How are fees charged or calculated?

Title insurance rates in New York are mandated and set by state regulation via the Title Insurance Rate Service Association. Rates vary based on where the property lies, the mortgage amount, and purchase price. Ancillary charges, such as Patriot searches and bankruptcy searches, are permitted to be charged to the buyer. These fees must be disclosed.

What is a lender (mortgage) policy?

When purchasing a property with a mortgage loan, the lender requires a mortgage policy. This insures the that the lender has a valid first lien on the property. If a title defect or issue arises, the lender is covered for its interest in the property (the mortgage amount). This policy is paid for by the buyer, but insures the lender.

What is an owner (fee) policy?

When purchasing a property, an owner or fee policy insures the owner against title defects not covered under the mortgage policy. Purchasers risk financial loss if there are defects in the title. Forgeries, boundary line disputes, and open liens are just a few examples. The fee policy is a one-time cost and covers the owner for the lifetime of ownership.
